Ltd.("Company") a Private Company limited by shares which got incorporated under the provisions of the Companies Act, 2013, and having its registered office located at B-43, 2ND Floor, Shankar Garden, VikasPuri, West Delhi, New Delhi-110018, and also the expression “eStartIndia or eStartIndia.com” shall, unless repugnant to the context thereof, be deemed to include its respective representatives, delegates, managers, administrators, officers, specialists, directors, and their successors and relegates. 

d) The term 'You' &'User' or ‘Client’ or ‘Customer’ shall mean any lawful individual or entity accessing to or using the services offered on this Website, who is capable to be a party to binding contracts, in accordance to the provisions of the Indian Contract Act, 1872;

14. DISPUTE RESOLUTION AND JURISDICTION

It is expressly consented by the Parties hereto that the formation, interpretation, and performance of this Policy and any disputes arising out of them from this moment will be addressed through a two-step Alternate Dispute Resolution (“ADR”) mechanism. It is further consented by the Parties that the contents of this clause shall remain in its existence even after the termination or expiry of the Policy and/or Terms.

a) Mediation: If a dispute between the parties arises Parties will try to resolve the same amicably within themselves, giving mutual satisfaction to the parties. But if the parties are not able to reach such an amicable solution within thirty (30) days from the date of one Party notifying the other regarding the cause of a dispute, the dispute will be resolved by arbitration, as described below.

b) Arbitration: If the Parties are not able to amicably resolve a dispute through mediation, said dispute will be referred to arbitration with a sole arbitrator to be appointed by eStartIndia, and the award granted by such sole arbitrator must be valid and binding on both the Parties. The cost of the proceeding shall be borne by respective parties themselves, although the sole arbitrator may order in his/her discretion to one of the parties to bear all the cost. The language used for the purpose of arbitration has to be English, and the seat of Arbitration shall be the city of Delhi, India.

The Terms, Policy and any other agreements between the Parties are guarded by the laws, rules, and regulations of India and this is consented by the Parties. The Courts at Delhi shall have exclusive jurisdiction over any disputes arising between the Parties.
