Liquor License in Delhi

Introduction:

The rules and regulations concerning the sale and consumption of alcohol are different from state to state in India. The subject of alcohol is mentioned in the state list under the Seventh Schedule of the Indian Constitution. The liquor head of the excise department administered in Delhi. Every state has specified the legal age for the consumption of alcohol. According to Section 23 of the Delhi Excise Act, 2010 and Delhi Liquor License Rules, 1976, the legal age for alcohol consumption is 25. Licenses were issued for different categories of wholesale and retail liquor sales for the financial year 2021-2022 under the new policy. The License renewal is on 31st March after the end of the fiscal year. 

Types of Liquor:

There are two types of liquor are available in the Indian market:

  • Indian Made Foreign Liquor (IMFL): This kind of liquor refers to the Hard Liquor manufactured within India.

  • Imported Foreign Liquor (IFL): This kind of liquor manufactures outside India or in foreign and after it was imported into India. These types of liquors are generally more expensive than IMFL. 

Liquor Law in India

According to Article 47 of the Indian Constitution -“The State shall aim about the prohibition of the consumption except for the medicinal purpose of intoxicating drinks and other drugs which are injurious to the health of the person.” The five countries like Mizoram, Gujarat, Nagaland, Bihar, and Lakshadweep have banned the sale, purchase, and consumption of alcohol so these states are also called dry states.

Types of Liquor Licenses in Delhi

The Delhi Liquor License Rules, 1976 pronounced that the types of licenses serve liquor in Delhi. This act also ensures that it supplies safe and quality liquor to its consumers. The categories of licenses used to sell the different brands of liquor. A few liquor brands require a special trading license. They are mentioned below:

  • Indian Made Foreign Liquor (IMFL)

  • Country liquor

  • Denatured & Special Denatured Spirit

  • Rectified Spirit

  • Indian Made Foreign Liquor for a wholesale license

Granting of License: -

In this domain, Licenses are of various kinds. The granting provisions for a liquor license are a few of them given below:-

Grant of L-1 License

The L-1 license is for wholesale trading to companies, societies, partnership firms, and proprietorship firms on the condition that the applicant owns distillery, breweries, manufacturing units, or bottling plants. He/ she has to obey all the terms and conditions which are ordered by the concerned authorities.

Grant of L-6 License

The L-6 license requires the retail sales of foreign liquor/beer. This license is issued to choose undertakings of the Delhi government, namely DTTDC, DSIDC, DSCSC, and DCCWS.

Grant of L-9 License

The L-9 license is for the retail sale of various brands of Indian liquor and foreign liquor. Previously this license was known as L-52 D. The applicant requires to abide by the terms and conditions ordained by the concerned authorities for attaining the license.

Grant of L-10 License 

The L-10 license is also for the retail sale of various brands of Indian liquor and foreign liquor. But the terms and conditions which are for an L-9 License do not apply to an L-10 license.

Grant of P-10 and P-13

The P-10 and P-13 licenses are temporary licenses that are for serving liquor at parties, functions, and conferences. The terms and conditions lay down for these licenses vary for residents, hotels, clubs, restaurants, and other premises.

Grant of L-15 and L-16

These licenses are given to the star hotels which are approved by the Department of Tourism to accommodate the tourists. The hotel management has to follow the terms and conditions set down by the authorities.

Grant of L-17 and L-18

These licenses are approved by the Department of Tourism for the star Hotels. These hotels must be located in a commercial area with adequate space for parking. 

Grant of L-28

The L-28 license is for clubs that have been registered with the registrar of firms or the registrar of cooperative societies. These clubs provide the services of foreign liquor to their club members. All clubs which are agreed to follow the specified terms and conditions for this license.

Grant of L-29

The L-29 license is for clubs or mess which provides liquor or beer only for government servants. These licenses are not subject to commercial rates and rules. The procedure to acquire the license L-29 same as the L- 28 license procedure.

Application Procedure of Liquor License in Delhi

The Delhi Government has begun an online liquor license program to issue the licensed liquor to its citizens. The procedure for acquiring the online license is mentioned below:

  • Firstly: Log on to the website: - The applicant has to visit the official portal to start login on to the website.

  • Secondly: Log on to the Portal: - The licensee has to enter the username and password.     Applicants using it for the first time must click on the option of ‘Register’ to fill in all the details.

  • Thirdly: Click on the application form:-The licensee has to select the application form and enter all the required details.

  • Fourthly: Submit the Form: - After entering the details, the licensee can submit the form by entering the ‘Submit’ option.

  • Fifthly: Issuing the license: - Based on the request for the type of license, the officials will conduct proper verification, after which the certificate will be issued.

Renewal of license

Every year renew the licensed liquor in Delhi with pay the appropriate fee.

Cancellation of License:

If the licensee violates any rules laid down by the authority then the authority cancels the liquor license of the licensee. The cancellation will be enacted on those licensees who sell alcohol on dry days or to minors which are added by the government of India.

Conclusion:

It concluded that the legal age of consumption of liquor is 25 years under Section 23 of the Delhi Excise Act, 2010 and Delhi Liquor License Rules, 1976. Licenses were issued for different categories of wholesale and retail liquor sales for the financial year 2021-2022 under the new policy. A liquor license is given under the Excise department of authority in Delhi. The License renewal is on 31st March after the end of the fiscal year.
