CHILD LABOR IN INDIA

India is the home of largest number of child labour in the world. The word “child” is defining under child labour (prohibition and regulation) act, 1986.  Under this act “child” is a person who is not attained the age of fourteen years. In this tender age person expected to enjoy his /her childhood, seek education, gain a strong value system, gain values from family. Child labour effect child mental and physical health and also give them the burden of responsibility to support their family. It is observed that children are forced to do child labour due to financial conditions, lack of food, clothes, shelter, livelihood, etc.

INTERNATIONAL LABOUR ORGANISATION 

ILO Defines child labour only not affect their childhood but also does not let them get an education, social values, and other norms. Child who work below the age of 14 years does affect mentally, physically and socially. Child labour is one of the black truth of society.

Causes of child labour in India

In India the major causes of child labour are-

1.    Poverty- In developing countries like India, it is almost impossible to control child labour children are supposed to support themselves as well as their family. Due to poverty, the rate of unemployment and underemployment are high. So, the parents are sending their children at very low wages.

2.    Bonded labour- There is a large scale of children in bonded labour. work is done by the children forcefully at very low wages.

3.    Domestic help- In developing countries like India there is a gap between rich and poor due to this the poor one is need money for their livelihood so they go to the house of the rich people for domestic help to get some money.

4.    Child sex workers- Most of the child girls are forced to become a sex worker in lieu of money.

5.    Previous debt- Due to lack of money or poor economic condition person takes a loan but they don’t have sufficient money to pay back, so they payback in the form of labour, they work in their houses or factories to pay back their money in other forms.

6.    Forced begging- children are forced to beg, due to their poor financial condition and to support the family.

7.    Professional needs- some of the industries like bangle industries need delicate and soft hand so they prefer children rather than adults to work in their industries.

SOME OF THE PREVENTIONS TOWARD PROTECTION OF THE CHILD LABOUR

•    Identifying the root cause of child labour. Identifying causes which force families and community to allow child labour.

•     Interact with parents, community leaders and tell them the importance of child education and other important things related to child.

•     Empowering communities with the knowledge to demand proper implementation of employment scheme and access to all government provisions.

•    Rescue children who forced into child trafficking.

LAWS FOR PROTECTION OF CHILDREN AGAINST CHILD LABOUR

1.    The Factories Act, 1948.

2.    The Mines Act, 1952.

3.    The Child Labour (Regulation and Prohibition) Act, 1986.

4.    The Right of Children to Free and Compulsory Education Act, 2009.

5.    The Juvenile Justice (care and protection) of Children Act, 2000.

Types of child labour in India-

1.    Slavery.

2.    Child Trafficking.

3.    Debt Bondage.

4.    Serfdom.

5.    Forced labor.

6.    Beggary.

THE POCSO ACT,2012

The Protection of Children from Sexual Offences Act was introduced to protect the children from sexual abuses. Sexual abuse on children is a big blot on society at large as it shook’s the human awareness of the society and reduce the normal healthy growth of children. Child abuse effect on mental and physical health of the children. POSCO ACT has been come out of the very need of the enact specific legislation to tackle the increasing sexual abuse against children.

CONCLUSION

Child labour is one of the biggest problems of the nation, in the developing countries like India there is an unsolvable problem to rid from child labour. There are so many measures taken by the government to deal with this problem of child labour.
